New Mexico titles boats by length. A motorized boat under 10 feet can register without meeting the legal definition of boat, so titling is optional. At 10 feet or more, residents must title it. A Coast Guard-documented boat carries a federal title instead.
Transferring a used, titled boat needs the Certificate of Title (copies not accepted), a Bill of Sale on Form MVD-10009 showing price, an HIN inspection by an inspector, officer, or ranger, and a lien release. Lacking ownership documents, the fallback is the Affirmation Certifying Ownership, Form MVD-10010, backed by whatever proof exists, plus a surety bond.
We could not find a statewide program for abandoned boats in New Mexico, through State Parks or the MVD. Boating rules cover navigation, alcohol, towing, anchoring, and the engine cut-off switch law, but nothing about an abandoned boat. Rangers, sheriffs, and state police handle general oversight instead.
If the boat is not yours. We could not find a New Mexico procedure letting a property owner take ownership of a boat left behind. The affirmation process, Form MVD-10010, is built for an owner who lacks paperwork, not a landowner dealing with someone else's abandoned boat. Your option is general civil process: find the owner, sue for removal costs, and hope they are solvent. Most people skip that and call a removal service instead.
